TERMS & CONDITIONS

These Terms and Conditions of Service ("Terms") constitute a legally binding agreement between GGOSH ("GGOSH," "we," "us," or "our") and the party utilizing our services ("Sender," "you," or "your").
By using GGOSH's courier, handling and related services, the Sender and the Recipient (collectively, "Users") agree to be bound by these Terms.
These Terms are physically displayed at all GGOSH branches and published electronically on the GGOSH website.
1. SCOPE OF AGREEMENT AND KEY DEFINITIONS
1.1 DEFINITIONS

“Sender” means the individual or business that contracts with GGOSH for Parcel handling.

“Recipient” means the party designated by the Sender to receive the Parcel.

“Parcel” means any physical item, package, document, or goods tendered to GGOSH for handling.

“Drop Date” means the date the Parcel is received by the Destination Branch.
-
“Claimed Date” means the date the Parcel is successfully collected and paid for by the Recipient.
-
“COP Amount” means the declared value or cash amount to be collected from the Recipient upon pickup (Cash on Pickup).
2. SENDER’S OBLIGATIONS REGARDING PACKAGING AND CONTENT
2.1 PROPER PACKAGING
The Sender is solely responsible for ensuring the Parcel is properly and adequately packaged to protect its contents against damage during normal handling and transit. GGOSH shall not be liable for any damage, loss, or deterioration resulting from insufficient or improper packaging.
2.2 PROHIBITED GOODS AND LEGAL COMPLIANCE
The Sender warrants that all Parcels comply with all applicable national and local laws, rules, and regulations. The Sender guarantees that the Parcel does not contain any Prohibited or Restricted Goods, including but not limited to:

Hazardous materials, explosives, or flammable items.

Illegally acquired goods, weapons, or contraband.

Items of high value not declared and approved by GGOSH.

Perishable goods or items requiring controlled environments, unless pre-approved by GGOSH.
2.3 INSPECTION AND DOCUMENTATION
GGOSH reserves the right to open and inspect any Parcel, in the presence of the Sender or without notice, for safety, security, customs, or other regulatory reasons. The Sender must accurately declare the true content and value of the Parcel at the time of drop-off.
2.4 INDEMNIFICATION
The Sender shall indemnify, defend, and hold harmless GGOSH from and against any and all liability, damages, losses, claims, or costs (including legal fees) arising from:

The Sender's breach of this Section 2.

The sending of prohibited or restricted items.

Any incorrect or false declaration of content or value.
2.5 LABELING

The Sender must ensure the Parcel is clearly and properly labeled with the following details:

3. FEES, CHARGES, AND PENALTIES
3.1 SERVICE FEES
Handling Fees and Transfer Fees are calculated based on the Parcel’s size and weight. Minimum fees start at P20 and will be determined at the time of drop-off. All Fees shall be paid by the Recipient upon pickup.
3.2 PAYMENT

Unless otherwise agreed, all fees shall be paid by the Recipient upon pickup.

For Parcels with no declared value (non-COP), any unpaid Transfer Fees must be settled by the Sender upon requested pullout.

Pullout Requests for Parcels with a declared COP amount are FREE of charge within 60 days.

If a Parcel has a declared amount for collection and the Recipient claims prior payment to the Sender, the Recipient must provide verifiable proof of payment at the time of pickup. Acceptable proof includes a payment receipt or a documented screenshot of the communication with the Sender. GGOSH reserves the right to deny pickup until satisfactory proof is provided.
3.3 STORAGE PENALTIES
A storage penalty will be incurred for Parcels that are not claimed promptly.

A penalty of P10 shall be charged for every week the Parcel remains uncollected at a GGOSH Branch, starting from the seventh day since Drop Date.

For Transferred Items, penalties may vary depending on the destination branch or partner’s policy.

Users are strongly advised to claim items within 2-3 days since Drop Date to avoid penalties.
4. UNCLAIMED AND PENDING PARCELS
4.1 CLAIM PERIOD

GGOSH strongly recommends all Recipients claim Parcels as soon as they are available for pickup.

All parcels must either be claimed by the recipient or retrieved by the sender (via pullout request) within 60 days from Drop Date. This 60-day window is the Claim Period.
4.2 RIGHT TO DISPOSE

GGOSH shall no longer be liable for any Parcels, whether directly dropped or transferred, that remain unclaimed by the Recipient or unretrieved by the Sender after 60 days from Drop Date.

Any Pullout Request submitted after the 60-day deadline shall be denied.

GGOSH reserves the right to dispose of the items in any manner it sees fit (e.g., liquidation, donation, destruction) without further liability or obligation to the Sender.

All Pending Parcels shall be deleted from GGOSH Main Database after 60 days from Drop Date.
5. CASH-OUT AND FUND REMITTANCE
5.1 AVAILABILITY OF FUNDS

Direct Drop-off Parcels: Cash-out is available immediately once the Recipient has successfully claimed the item and paid the corresponding fees and amount.

Transferred Parcels: Cash-out is available only upon successful cash remittance from our partner branches/locations. Remittance updates are scheduled after Transfer Day.
5.2 IDENTIFICATION REQUIREMENT

The Sender must present any Valid ID or their Verified Facebook Profile upon Cash-out to confirm identity. NO ID, NO CASH-OUT.
5.3 ADMINISTRATIVE FEES FOR UNCLAIMED FUNDS
If funds remain unclaimed by the Sender after 60 days from Claimed Date (the date the Recipient claimed the parcel), the Sender agrees to an Administrative Fee that shall be deducted from the total Cash-out amount. The Fee is:

P100.00 per month OR 2% of the fund amount, whichever is higher.
5.4 FUND CLAIM DEADLINE
The Sender must provide an accurate list of Item Details (Drop Date, Seller Name, Buyer Name, Amount, Date Claimed) for verification. All Cash-out requests made after 90 days from the Claimed Date shall be denied, and the remaining funds shall be forfeited to GGOSH.
6. LIMITATION OF LIABILITY AND CLAIMS
6.1 MAXIMUM LIABILITY FOR LOSS OR DAMAGE
GGOSH’s liability for any loss, damage, or misdelivery of a Parcel is strictly limited to the lower of the following:
(a) the actual declared value of the item, OR (b) an amount not exceeding One Thousand Pesos (P1,000.00),
unless the Sender has purchased Declared Value Insurance Coverage prior to the Drop Date.
Declared Value Insurance Coverage Terms:

Fee Calculation: The fee for Declared Value Coverage is three percent (3%) of the portion of the declared value that exceeds P1,000.00. A minimum fee of P50.00 applies to all coverage purchases.

Increased Limit: Where Declared Value Coverage is purchased, GGOSH’s maximum liability is increased to the declared value stated by the Sender at the time of drop-off, subject to the maximum insurable limit set by GGOSH (currently P50,000.00).

Exclusions: GGOSH shall not be liable for any consequential or indirect damages, including but not limited to loss of profits, loss of income, or loss of market, whether or not GGOSH had knowledge that such damages might be incurred.
6.2 CLAIM SUBMISSION DEADLINE

All claims for loss or damage must be submitted in writing to GGOSH within twenty-four (24) hours of the Recipient's pickup or the date the Parcel was confirmed lost. Claims submitted after this period shall be automatically waived.

Video Evidence Mandate: To be eligible for liability coverage under Section 6.1, claims for physical damage, loss, or incorrect contents must be supported by a continuous, uncut video recording of the Recipient's unboxing process. The video must be recorded immediately upon receipt, within the branch or designated immediate vicinity.
7. GOVERNING LAW AND AMENDMENT
7.1 GOVERNING LAW AND VENUE
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any legal action or proceeding arising under these Terms shall be brought exclusively in the appropriate courts located in Bauang, La Union.
